| metadata.dc.description.resumo: | O Jus Postulandi é o instituto que possibilita a parte, sem a presença de um advogado, postular, perante o juízo, reparação de direito violado. O Jus Postulandi é amplamente aplicado no âmbito da Justiça do Trabalho, sendo facultado tanto ao empregado como ao empregador o acompanhamento por advogado. O efetivo acesso à Justiça vai muito além da simples possibilidade de ingressar em juízo, perfaz a necessidade de conhecimento técnico, recursos financeiros, e deve garantir a dignidade da pessoa humana e o devido processo legal. O Estado tem o dever constitucional de garantir o acesso à Justiça, não só por meio das Defensorias Públicas como também através de advogados por ele custeado. |
| Abstract: | The Jus Postulandi is the institute that enables part, without the presence of a lawyer, postulate, before the court, repairing the violated right. The Jus Postulandi is widely applied in the Labor Court, which provided both the employee and the employer follow-up by a lawyer. The effective access to justice goes beyond the mere possibility of joining the court, makes the need for technical expertise, financial resources, and must ensure the human dignity and due process. The state has a constitutional duty to guarantee access to justice, not only through the Public Defender as well as by lawyers funded by him. |
