| metadata.dc.description.resumo: | Trata-se da defesa da equiparação jurídica dos relacionamentos homoafetivos à união estável entre homens e mulheres, haja vista a ausência de vedação constitucional nesse sentido, a necessidade de interpretação do artigo 226, § 3° da Constituição em conformidade com os princípios da igualdade, liberdade, dignidade da pessoa humana, e dos objetivos da República Federativa do Brasil bem como da compreensão que o referido artigo é uma norma inclusiva e não exclusiva. Aborda também a inércia do Poder Legislativo para com o tema tratado, a evolução jurisprudencial do tema e a urgente necessidade de manifestação estatal sobre o assunto. |
| Abstract: | It treats about the defense of legal equiparation of the homoafective relationchips to a stable union between men and womem, considering the absence of a constitucional prohibit in this case, the necessity of article 226, § 6º Constitution interpretation in according to the principles of iguality, liberty, dignity of the human been and of the objectives of the Brazilian Federative Republic, as well the comprehension that the referred article is an inclusive rule, not an a exclusive one. It also treats the inertia of the legislative power with the treated subject, the jurisprudential evolution of the theme and the urgent necessity of the state manifestation about the subject. |
